Brexit Draft Agreement by Theresa May and the Alternative view of Desmond Last


The Draft Agreement click here to read which I say should state ‘subject to the majority consent of the democratically elected Parliament of the United Kingdom’.

The EU makes much of its democracy – it does not end at Dover.

The agreement reads………………
RECOGNISING that, even if Union law will be applicable to and in the United Kingdom during the transition period, the specificities of the United Kingdom as a State having withdrawn from the Union mean that it will be important for the United Kingdom to be able to take steps to prepare and establish new international arrangements of its own, including in areas of Union exclusive competence, provided such agreements do not enter into force or apply during that period, unless so authorised by the Union.

The United Kingdom has a Head of State – the Queen and an Elected Parliament. We cannot agree to a transition system of Government which in effect removes both.

The Agreement reads……..RECALLING that the Union and the United Kingdom have agreed to honour the mutual commitments undertaken while the United Kingdom was a member of the Union through a single financial settlement.

I say that no account has been taken of the contribution both financial and of endurance by the United Kingdom since it joined the European Community. I say that this matter should be decided by the Courts not European Political appointees with grand aspirations. This matter should be set aside from the agreement until such times as a Court expert in these matters has given judgement.

The Agreement States This Agreement sets out the arrangements for the withdrawal of the United Kingdom of Great Britain and Northern Ireland (“United Kingdom”) from the European Union (“Union”) and from the European Atomic Energy Community (“Euratom”).

I say it should say the ‘Parliaments of the United Kingdom to include the wishes of the People in England, Scotland, Wales and Northern Ireland and all others so governed to be named. That to include the wishes of the people of Gibraltar’.

This is the most pivotal point of the Brexit debacle – for that is what it has become.

I say that the Question must be asked ‘Why is the United Kingdom agreeing to a Transition period that a) removes sovereignty from the Nation and b) produces a U.K that is effect is totally governed by those who aspire to a European Federated State and c) is going to leave the U.K with no nett gain from its payment of 50 Billion Pounds (whatever figure is given it will be more) to the E.U.

Cancel the Transition Period, Suspend Article 50 or withdraw it, Remain a fully-paid up member of the E.U and negotiate the terms of trade for Brexit. When finally there is a Brexit all are agreed on – Leave the E.U. What is the point of the Transition Period when we are able to withdraw Article 50 and negotiate terms that both the the UK and the EU can agree on without this damaging, costly and hysterical haste?

The scale of Theresa May’s challenge became clear on Thursday. A string of ex-cabinet ministers, including Boris Johnson and Dominic Raab, accused her of locking the UK into the EU’s sphere of influence after withdrawal. Do you agree with them?

I answered

Yes I do. PM May has made an absolute mess of the Transition Period.

It completely removes British Sovereignty and the right of the British People to decide their own fate both socially and economically.

It also prevents the United Kingdom from entering into any Trade Agreements until the Transition period is over.

There is also the danger that the lack of any agreement over UK\EU fishing rights is a) gong to end in a Royal Navy intervention and the resultant diplomatic debacle and b) the UK will bend over and give away too much. This should not be used a a bludgeon by the E.U in the transition period to gain unfair fishing rights.

I would cancel the Transition period, delay Brexit and finalise the negotiations then leave. Now we have a Draft Agreement we do not need a Transition period.
